Designated driver gets smashed?

My buddy and his friend went out a few weeks ago and the one guy promised to be the driver. They seperated for a while and meet back up to drive home. On the way home the friend realizes his buddy who is behind the wheel is totaled. My friend begged him to stop only for his now drunk designated driver will not stop and drop friend off and speeds to the closet bar and wants to drink more.So now the only one who is drinking is the one who was sopposed to stay sober and the guy that wanted a night out is stuck. A few hours later with my friend sobering up decides to take his drunk buddy home and be done with him all together. Sure enough the guy who sobered some up gets slammed and hit with a dui. Does he have legal ground to sue his now ex friend for damages for fines, loss wages and so on?
